Rule Adoption Schedule and Support Documents

The following rules are in the rulemaking schedule for revision or adoption. Rules will be listed here in numerical order, with a description of the rule; the projected or actual hearing dates; the staff contact; and any related documents available (e.g., rule revisions, staff reports).

  • Table 1 lists rules that may be adopted or amended in 2008.
  • Table 2 lists rules that may be adopted or amended after 2008.

Solvent Degreasing Solvent Degreasing (to be renamed: Solvent Cleaning Machines and Solvent Cleaning) - Revise to incorporate changes committed to in the 2001, 2004, and 2007 Clean Air Plans. The revised rule will include additional control techniques for solvent cleaning machines and new control techniques for general solvent cleaning. After revisions have been made to Rule 321, rules that are for specific operations involving the use of application equipment (e.g. Rules 330, 337, 339, 349, 351, 353 and 354) will be revised (see table below) to include new solvent cleaning requirements. 2008 or 2009 Doug Grapple

Storage and Transfer of Gasoline: Add two exemptions to allow vehicle refueling without a Phase II vapor recovery system provided:

1) the product dispensed is E85 (an ethanol-gasoline blend), or 2) the station is a non-retail gasoline dispensing facility dedicated to refuel only motor vehicles equipped with onboard refueling vapor recovery systems.

Minor changes to the definitions in Rule 102 are also proposed.

1001 National Emissions Standards for Hazardous Air Pollutants (NESHAPs) (Revision) – Revise our National Emission Standards for asbestos to be more consistent with Ventura APCD’s (and other surrounding area Districts) asbestos rule rather than simply referring to the Federal NESHAPs (Part 61, Chapter I, Title 40 of the Code of Federal Regulations, Subpart M). No action is currently taking place on this rule. This rule is slated for possible amendment in 2006. Reg. XI Public Notification - Update regulation (originally adopted in 1980) to include current procedures to notify the public about exceedances of any primary air quality standards, and any associated health hazards. This regulation also includes guidelines for daily and annual reporting of air quality, and serves as a means to increase public awareness of air quality and involvement in the APCD’s clean-air efforts.
