Storage and Transfer of Gasoline

We are proposing to add two exemptions to Rule 316, Storage and Transfer of Gasoline. These exemptions will allow vehicle refueling without a Phase II vapor recovery system provided:

1) the product dispensed is E85 (an ethanol-gasoline blend), or
2) the station is a non-retail gasoline dispensing facility dedicated to refuel only motor vehicles equipped with onboard refueling vapor recovery systems.

The APCD also proposes minor revisions to Rule 102, Definitions, to clarify the rule provisions.

APCD staff plan to present the proposed amended rules to the Community Advisory Council at the October 22, 2008 meeting. The public will have an opportunity to provide input at this meeting/workshop. It is anticipated that the APCD Board will consider adoption of the revised rules on January 15, 2009.

The APCD has prepared a draft Background Paper on this project, which includes the proposed amended rules (Appendices A and B). The draft Background Paper or proposed revised rules for the project may be downloaded for review on this page. Paper copies are also available upon request.

Solvent Cleaning Machines and Solvent Cleaning

We will be proposing modifications to Rule 321 to implement revised requirements for solvent cleaning machines and new requirements for solvent cleaning (e.g., wipe cleaning). The proposed revised Rule 321 will contain solvent reactive organic compound (ROC) content limits, revised equipment requirements for degreasers, and sanctioned solvent cleaning devices and methods.

Staff is currently investigating concerns raised at a public scoping meeting on the project on August 5, 2008. Before the next public workshop (yet to be scheduled) we will announce that a proposed amended Rule 321 and its supporting draft Background Paper are available for public review.

After the Board has adopted revisions to Rule 321, the APCD plans to propose changes to rules that apply to specific operations (e.g. Rules 330, 337, 339, 349, 351, 353 and 354) These proposed changes will include new solvent cleaning requirements associated with surface preparation and application equipment clean up.

Rule 333 has been revised  to address ARB and EPA concerns. Rules 102 (Definitions), 201 (Permits Required) and 202 (Exemptions to Permits) have also been revised.  Certain types of portable construction equipment, including air compressors, generators, concrete pumps, abrasive blasting equipment, pile drivers, welders, cranes and construction drill rigs are no longer exempt from permits.

Portable construction engines rated 50 brake horsepower (bhp) and above that are operated in Santa Barbara County will be required to be either: 1) registered in the statewide portable equipment registration program, or 2) permitted by the District by September 18 of this year.

Rule 339 has been revised to include the Suggested Control Measures for Automotive Coatings adopted by the state. This revised rule affects all automotive refinishing shops and mobile equipment coating operations located in Santa Barbara County. The revised rule: 1) reduces the amount of allowable volatile organic compounds (VOCs) in the coatings; 2) controls the VOC limits (to a maximum of 25 grams per liter) for solvents used in association with painting; and 3) includes an exemption for pre-sanding solvent to remove grease, wax, and road tar. This exemption includes a limit of 20 gallons per year per facility.

Most elements of this rule, including most VOC limits, will take effect on January 1, 2009. By January 1, 2010, VOC limits for all coating and solvent cleaning categories will be in effect.
