APCD Hearing BoardThe APCD Hearing Board is a panel made up of five members appointed by, but acting independently of, the APCD Board of Directors. The members of the Hearing Board have professional experience in the fields of medicine, engineering, law, and include two members of the public. The Hearing Board is a quasi-judicial body established to hear appeals of Control Officer permit decisions, applications for variances from District Rules and Regulations, and petitions for abatement orders submitted by the Control Officer. Appointment of each Hearing Board member is made for a term of three years.

What is a Variance?A variance is an administrative order granting temporary relief from the provisions of an air quality regulation. A variance allows operation while steps are being taken to come into compliance with the regulation in question. How is a Variance requested?Persons or companies requiring a variance from the District Hearing Board shall first determine they have met the Findings Required for Issuance of Variance. Once the findings have been determined, an Application for Variance (PDF file) (Word file) may be filed by mail or in person at the APCD, 260 N. San Antonio Road., Suite A, Santa Barbara, CA 93110-1315, Attn: Sara Brumit. An appropriate fee is collected at the time the variance is requested. See "Schedule F" of the Fee Schedule. When does the APCD Hearing Board meet?The APCD Hearing Board meets on an as-needed basis, often the first Wednesday of the month at 9:30AM in the Board of Supervisor's Hearing Room at the addresses below. Meeting site is determined by the case(s) being heard, and are only held when there are agenda items. In addition to regular meetings, Hearing Board members may be called upon to hear individual Emergency Variance cases as they arise.

Next APCD Hearing Board MeetingPersons may address the Board on any matter listed on the agenda by completing and delivering to the Clerk a speaker slip before the item is considered. Matters not listed on the agenda may be addressed at the public comment period following the administrative agenda. In compliance with the Americans with Disabilities Act, individuals needing special accommodations to participate in the meeting should contact the APCD at least three working days prior to the scheduled meeting.
